In recent years Lotteries have now been used to allocate places at oversubscribed schools in some areas. Serious consideration is given to whether such experiments might legitimately be used more widely. The intention is not to advocate or deprecate the use of random methods in this context, but to consider whether, in relation both to the range of substantive values at stake in admissions decisions and the background constitutional and legal norms, random methods might be considered any more or less legitimate than the approaches based on planning or choice considered earlier. In this sense, giving due consideration to the use of random-based methods may serve as a heuristic device: if approaches based on planning or choice are found not to deliver processes or outcomes preferable to those which random methods would deliver, their claims of legitimacy must be considered weak indeed.
